Report 26-172

This report seeks Council authorization for the City of Kingston to enter into a Limiting Distance Agreement with the owner of 166 West Street to facilitate the adaptive reuse of a designated heritage property while maintaining Ontario Building Code compliance. The owner proposes to renovate an existing carriage house into a two-storey residential dwelling with increased unprotected window and door openings on the south elevation. To accommodate these openings beyond OBC requirements, the agreement would allow the limiting distance calculation to extend into adjacent City-owned Court House parking lot lands (approximately 77.85 square metres). The agreement would restrict future construction in this area to maintain required safety separation distances. The proposal has been approved through planning and heritage processes, with minimal impact to the City as the parking area is not designated for near-term redevelopment. The recommendation is to authorize the Mayor and City Clerk to execute the agreement on terms satisfactory to the Chief Building Official.

Report 26-113

Queen's University and the Alma Mater Society have jointly applied for exemptions to the City's Noise By-Law for events during their 2026 Orientation Week, scheduled for September 4-7 and September 11-13, 2026. The application covers Residence Move-in Day activities and Fall Orientation events held on Queen's Main Campus, West Campus, and various city-owned properties. Compared to 2025, Queen's has reduced the number of events on city-owned property from 11 to 7 to minimize community impact. Events include on-campus activities utilizing amplified sound, as well as seven specific events on public property such as the Glow Bash, Thundermugz, Breakfast and Cheer Off, and Highland Games. Some events will require temporary road and lane closures for safety and logistics. The report recommends granting noise by-law exemptions for these events during specified dates and times.

Report 26-148

This report presents a plan to establish a public Municipal Services Corporation for Water & Wastewater Services in the City of Kingston. The proposal seeks to address the City's significant infrastructure renewal needs, estimated at $228M annually for water/wastewater and municipal assets combined. Currently, the City lacks sufficient borrowing capacity to fund these requirements through traditional financing methods. The public municipal service corporation model, established under the Municipal Act 2001, would allow Utilities Kingston to issue its own debt separately from the municipality while remaining in public ownership. This structure would provide greater financial flexibility for water and wastewater infrastructure investments and free up the City's borrowing capacity to address other municipal priorities including roads, transit, parks, and affordable housing. The report recommends Council endorsement in principle and authorization to develop a draft shareholder declaration for future approval.

Report 26-100

Report 26-138

This report addresses the City's acquisition and disposition of two former Catholic school properties declared surplus by the Algonquin & Lakeshore Catholic District School Board: St. Peter Catholic School and St. Patrick Catholic School. The City has negotiated Agreements of Purchase and Sale with the School Board to secure these properties for institutional use. For St. Patrick Catholic School (valued at $2,243,000), the City will conduct an Expression of Interest process to identify an institutional user for acquisition. For St. Peter Catholic School, the City will first complete due diligence with the intent to acquire the property and subsequently lease or lease-to-own it to an institutional user. The report recommends Council approve the purchase and disposition of St. Patrick Catholic School, authorize budget amendments totaling $2,298,000 for purchase price and closing costs, and waive the surplus property declaration requirement given the non-municipal use.

The application deadline is June 19, 2026, with funding approval not guaranteed. Importantly, the DC rate reduction would only take effect upon satisfactory provincial contribution terms and execution of a Transfer Payment Agreement, allowing Council a final decision point once actual funding allocation is confirmed.

A By-Law to Exempt Certain Lands on Registered Plan 754 from the Provisions of

This by-law exempts specific parcels of land (Part of Block C on Registered Plan 754, being Parts 1, 2, 3, and 4 on Reference Plan 13R-23524, located at 450 Portsmouth Avenue and 5 Miles Avenue in Kingston) from the prohibition on conveying parts of lots or blocks within a registered plan of subdivision. The exemption permits a lot line adjustment and the establishment of easements for vehicular access and utility servicing purposes. The by-law came into force on June 16, 2026, and expires on June 16, 2028.
